Reverse charge guide
Reverse charge invoices for creators: brand or agency abroad.
If your client is not in Germany, the place of your service moves with them: your video for a company in Paris counts as supplied in France, for one in New York as supplied in the USA. German VAT then does not belong on the invoice; depending on the case, a note, both VAT ids and a report to the Federal Central Tax Office do. What belongs on an invoice to a brand in general is in the guide on that; this page covers only the foreign case, each point with its reference.

The basic rules.
Four sentences from the German VAT act that decide your invoice abroad.
Reverse charge invoice: the place of supply is your client's seat.
A service to a business for its business is supplied where the recipient runs its business. Your video, post or story for a brand is such a service. For VAT, what counts for an influencer is the place of supply, not your desk.1
Brand in the EU: without VAT, with a note.
If the brand owes the VAT in its member state, you must issue an invoice with the words „Steuerschuldnerschaft des Leistungsempfängers“. VAT rate and VAT amount are left off. This does not apply if you agreed on a Gutschrift (self-billing).2
Both VAT ids, by the 15th of the following month.
The invoice names your VAT id and the brand's and must be issued by the fifteenth day of the month after the month of the service. The tax administration adds: missing the deadline is not an administrative offence.3
Brand in the USA, Switzerland or the UK: not taxable in Germany.
VAT applies only to services a business supplies within Germany. If the place of supply is the seat of a company in a third country, Germany is not involved and no German VAT arises. German law does not require a reverse charge note under § 14a UStG for this case.4
Note, report, check.
What is left to do after the basic rule: the right wording, the Zusammenfassende Meldung, the advance VAT return and the brand's VAT id.
The wording, in English too
Required are the words „Steuerschuldnerschaft des Leistungsempfängers“. Instead of the German term you may use the phrase another official EU language uses in the VAT Directive: "Reverse charge" in English, "Autoliquidation" in French, "Btw verlegd" in Dutch. The table is Anlage 8 of the Umsatzsteuer-Anwendungserlass.5
Zusammenfassende Meldung by the 25th after the quarter
Services to businesses elsewhere in the EU for which the recipient owes the VAT you report to the Federal Central Tax Office by the 25th day after the end of the calendar quarter: each brand's VAT id, the sum of the fees and the flag that these are services. You report the quarter in which you supplied the service, not the one of the invoice.6
In the advance VAT return too
You declare the same supplies separately in the Umsatzsteuer-Voranmeldung, for the period in which you supplied the service. No VAT falls due on them; both reports rest on the same taxable amounts.7
Check the brand's VAT id with the BZSt
If the brand uses its VAT id, you may as a rule assume that it is a business and receives the service for its business. Condition: you had the number confirmed by the Federal Central Tax Office. The qualified confirmation also checks name and address; keep the result as a printout or screenshot.8
Customer without a VAT id
If a customer elsewhere in the EU uses no VAT id, you may in principle assume they are not a business, as long as you know nothing else. The place of supply is then yours, and German VAT belongs on the invoice. A number printed in the letterhead alone is not enough as proof.9
Wrongly shown VAT is still owed
If you put 19 % on the invoice although the brand owes the VAT or the supply is not taxable in Germany, you owe the amount shown to the tax office. For services where the recipient owes the VAT, the tax administration says so expressly. The only way out is a correction towards the brand.10
From the basic rule to the finished invoice.
That the brand in Paris owes the VAT is not only in German law. The VAT Directive places a service to a taxable person at that person's seat (Art. 44) and makes them liable for the VAT if the supplier is not established in their member state (Art. 196). Its English version requires the mention "Reverse charge" on these invoices (Art. 226 point 11a). Germany implements this in § 3a Abs. 2 and § 14a Abs. 1 UStG. No official text says expressly that a video or a post is such a service; that is a conclusion drawn from the law, not an explicit rule for creators. Have your tax adviser confirm it.
This is what the invoice to a brand elsewhere in the EU looks like: all mandatory details under § 14 Abs. 4 UStG, so names and addresses, invoice number, issue date, the service and its date (the calendar month is enough, § 31 Abs. 4 UStDV) and the fee, but no VAT rate and no VAT amount. Plus your VAT id and the brand's (§ 14a Abs. 1 Satz 3 UStG) and the words „Steuerschuldnerschaft des Leistungsempfängers“ or "Reverse charge" (§ 14a Abs. 1 Satz 1 UStG; Abschnitt 14a.1 Abs. 6 Satz 2 UStAE). You must issue it by the 15th of the following month (§ 14a Abs. 1 Satz 2 UStG). If the brand bills by Gutschrift, your duty to issue an invoice with the note falls away (§ 14a Abs. 1 Satz 1 UStG); check that document all the more closely for VAT shown, because if you do not object without delay, you owe it (§ 14c Abs. 2 Satz 2 Nr. 2 UStG).
The Zusammenfassende Meldung goes to the Federal Central Tax Office by the 25th day after the quarter in which you supplied the service (§ 18a Abs. 2 Satz 1 und Abs. 8 Satz 2 UStG). It names each brand's VAT id and the sum of the fees (§ 18a Abs. 7 Satz 1 Nr. 3 UStG); without the brand's number the supply cannot be reported. For a quarter without such services you file no ZM (Abschnitt 18a.1 Abs. 1 Satz 6 UStAE); it is filed electronically via ELSTER or the BZSt (Abschnitt 18a.1 Abs. 4 UStAE). If you notice a mistake later, you correct it within one month (§ 18a Abs. 10 UStG). In the advance VAT return you declare the same supplies separately (§ 18b Satz 1 Nr. 2 UStG). If you billed in dollars or pounds, you convert for both reports at the average rates the Federal Ministry of Finance publishes for the month of the service (§ 16 Abs. 6 UStG, via § 18a Abs. 7 Satz 2 und § 18b Satz 4 UStG). Which currency the invoice itself is in, § 14 Abs. 4 UStG does not prescribe.
If your client is in the USA, the UK or Switzerland, the place of supply is likewise with them (§ 3a Abs. 2 UStG), and the supply is not taxable in Germany (§ 1 Abs. 1 Nr. 1 UStG). The invoice carries no German VAT; § 14a Abs. 1 UStG requires a reverse charge note only for other member states, not for third countries, and the ZM covers only the rest of the EU (§ 18a Abs. 2 UStG). That your customer is a business you prove for example with a certificate from its tax authority; if that is not possible, how you prove it is up to you (Abschnitt 3a.2 Abs. 11 UStAE). If the customer in the third country is not a business, a service that serves advertising is still supplied at their residence or seat (§ 3a Abs. 4 Satz 1 und Satz 2 Nr. 2 UStG); whether your video falls under that, settle with your tax adviser. What the customer's country itself requires of you is governed by its law, not German law. A short line on the invoice saying why no VAT is charged is not required, but saves questions.
As a Kleinunternehmer you are exempt only for supplies within Germany (§ 19 Abs. 1 Satz 1 UStG). Your service to the brand in Paris, however, is not taxable in Germany but in France, where the brand owes the VAT. The law exempts you from showing both VAT ids (§ 19 Abs. 1 Satz 2 in connection with § 14a Abs. 1 Satz 3 UStG), from the advance return and the annual return (§ 18 Abs. 1 bis 4 UStG) and from the Zusammenfassende Meldung (§ 18a Abs. 4 UStG). The duty to write „Steuerschuldnerschaft des Leistungsempfängers“ from § 14a Abs. 1 Satz 1 UStG is not on that list of exceptions; by the wording it applies to you too. The Kleinunternehmer note under § 34a UStDV, on the other hand, does not fit this invoice: the rule is written for supplies exempt under § 19 Abs. 1 UStG, and your service is not exempt but not taxable in Germany at all. That is a conclusion drawn from the law, not an explicit rule: have it checked. As a business you get a VAT id on application from the Federal Central Tax Office (§ 27a Abs. 1 Satz 1 UStG); whether you apply for one, for example because the brand asks for it, is a decision for you and your tax adviser. The supply does not count towards the Kleinunternehmer limit, because only supplies taxable in Germany count there (§ 19 Abs. 2 Satz 1 UStG); more in the guide on the limit.
Affliq writes the invoice from the deal and derives the tax case from your partner's seat and VAT id: domestic, Kleinunternehmer, reverse charge in the EU or third country, each with the matching note, as PDF and e-invoice. If an agency books you, the invoice goes to the agency, with the tax case from its seat. Affliq prepares the advance VAT return from your invoices. You confirm the brand's VAT id yourself with the Federal Central Tax Office and file the Zusammenfassende Meldung yourself; Affliq only knows what you have recorded there.
Affliq records and does the maths, it does not advise. How things are taxed is your tax adviser's call.
Frequently asked questions
What has to be on a reverse charge invoice? The mandatory details.
Everything from § 14 Abs. 4 UStG except VAT rate and VAT amount: names and addresses of both sides, invoice number, issue date, the service, its month and the fee. Plus your VAT id, the brand's and the words „Steuerschuldnerschaft des Leistungsempfängers“. It is issued by the 15th of the month after the service.11
Reverse charge invoice template: what is the wording in German and English?
After the net amount, with no VAT line, in German: „Steuerschuldnerschaft des Leistungsempfängers“. In English the Directive's phrase is enough: "Reverse charge". If you want both, write „Steuerschuldnerschaft des Leistungsempfängers / Reverse charge“; the law asks for no more. A reference to § 13b UStG does not fit, because that section covers services for which a recipient in Germany owes the VAT.12
Is "Reverse charge" enough on an invoice in English?
Yes. The tax administration accepts the phrases the other language versions of the VAT Directive use for this mention; for English that is "Reverse charge". Your own paraphrases such as "VAT 0 %" or "tax free" are not in the table and mean something else: the VAT is not zero, it is owed by the brand.13
Reverse charge invoice to the USA: with or without the note?
Without German VAT, because the service to a company in the USA is not taxable in Germany. § 14a Abs. 1 UStG requires the words „Steuerschuldnerschaft des Leistungsempfängers“ only for other EU member states, and there is no Zusammenfassende Meldung for third countries. What duties US law knows is a question for your tax adviser; a short line on the invoice that the place of supply is the USA is not required, but helps against questions.14
The brand has no VAT id. Does reverse charge work without a VAT id?
If a customer in the EU uses no VAT id, you may in principle treat them as a non-business, provided you know nothing else: the place of supply is then Germany, and VAT belongs on the invoice. If the brand has applied for the number but not received it yet, you can prove its business status provisionally in another way; in the end only the issued number counts. Without it you also cannot report the supply in the Zusammenfassende Meldung.15
Kleinunternehmer: how do I invoice a brand elsewhere in the EU?
Without VAT, with the words „Steuerschuldnerschaft des Leistungsempfängers“, because § 19 Abs. 1 Satz 2 UStG does not exempt you from that duty. You are exempt from showing both VAT ids, from the advance VAT return and from the Zusammenfassende Meldung. That is a conclusion from the wording of the law; have your tax adviser confirm what your invoice should look like and whether you apply for a VAT id.16
Do I have to file a Zusammenfassende Meldung for reverse charge invoices, and when?
Yes, unless you are a Kleinunternehmer. The ZM goes to the Federal Central Tax Office by the 25th day after the quarter in which you supplied the service, with each brand's VAT id and the sum of the fees. If you already report monthly because of goods, you include the services in the report for the last month of the quarter.17
I charged a brand abroad 19 % VAT by mistake. What now?
You owe the amount shown to the tax office, although the brand owes the VAT or the supply is not taxable in Germany. Correct the invoice towards the brand; the correction takes effect in the period in which the corrected invoice is received, not retroactively. If the brand has already paid the excess, the correction is only permitted once you have paid the excess back.18
